Terms of Use

1. What this is

Testing Predictions (the "Game") is a free entertainment feature offered on and around Testing's website. You make yes-or-no predictions about upcoming local events, earn points when you are right, and can compare your results with other players. The Game is for fun. It is not gambling, not a wagering service, not a financial market, and not a source of financial advice.

The Game is operated for Testing by Prediction.Media ("we", "us"). These Terms are an agreement between you and Prediction.Media; Testing's own website terms also apply to the pages that host the Game.

2. No wagering, no cash value

Playing is always free. You never pay to play, and you never risk anything of value.

Points, streaks, badges, levels, and leaderboard positions are entertainment features only. They have no cash value, cannot be redeemed, sold, or transferred, and do not entitle you to any prize, good, or service. We may adjust, reset, or discontinue any scoring feature at any time.

Odds or probability displays that may appear alongside questions are informational context drawn from public sources. They are display-only: they are not an offer, invitation, or facility to trade, bet, or stake anything, and we do not link players to any trading or betting venue.

3. Eligibility

You must be at least 13 years old to play, and at least 18 (or the age of majority where you live) to create an account with contact details. If you are between 13 and 18, you may play as a guest only.

The Game is intended for players in the United States. You are responsible for making sure playing is lawful where you live.

4. Guest play and accounts

You can play without an account. Guest play is tied to your device; if you clear your browser data or switch devices, your guest history may not follow you.

Creating an account (a display name, plus optional email or phone) lets your progress follow you and, only if you opt in, lets us send you Game notifications. You can stop those notifications at any time.

You are responsible for the accuracy of what you provide and for anything done under your account.

5. Display names and conduct

Display names are public. Choose one that does not impersonate anyone and is not offensive or misleading. We may reject, reset, or moderate any display name.

You agree not to cheat, exploit bugs, use automation to play, interfere with other players, or attempt to access other players' data or the Game's systems. We may suspend or remove any player who does.

6. Question resolution

Every question states its resolution source. Outcomes are resolved by Testing and Prediction.Media operators using that source. Resolution decisions are final. Questions may be voided (with any points adjusted) when an event is canceled, postponed, or the stated source cannot resolve it.

7. Our content and license

The Game - its software, design, questions, and content - belongs to Prediction.Media or its licensors. Partner branding belongs to the partner. We grant you a personal, non-exclusive, revocable license to use the Game for your own entertainment. No other rights are granted.

8. Sponsors and advertising

Parts of the Game may be presented by sponsors, and Game pages may include advertising or sponsored editorial content. Sponsored content is labeled. Sponsors do not decide question outcomes.

9. Third-party sources

Questions, odds displays, and stories may reference third-party publications, data providers, and public markets. We are not responsible for third-party content, and referencing a source is not an endorsement.

10. Disclaimers

The Game is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted availability. Nothing in the Game is financial, investment, or betting advice, and you agree not to rely on it as such.

11. Limitation of liability

To the fullest extent the law allows, Prediction.Media, its partners (including the publisher whose brand appears on the Game), sponsors, and their respective officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from the Game. Because the Game is free, our total aggregate liability to you for all claims relating to the Game is capped at one hundred US dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless Prediction.Media and its partners from claims arising out of your breach of these Terms or your misuse of the Game.

13. Disputes: arbitration and class action waiver

Any dispute arising from these Terms or the Game that we cannot resolve informally will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. YOU AND PREDICTION.MEDIA EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of this arbitration provision by emailing us within 30 days of first accepting these Terms. Small-claims court and injunctive relief for intellectual-property misuse remain available to both parties.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.

14. Changes and contact

We may update the Game or these Terms; material changes will be posted here with a new effective date, and continued play after that date is acceptance. If any provision is unenforceable, the rest stand.
